Terms + Conditions

 

By enrolling your child at Upstage Lab, you accept these terms and conditions  and sign your agreement to them as an ongoing agreement between you and
Upstage Lab .
The Agreement is made between the parent/guardian of each
enrolled student by a Parent and Upstage Lab a brand part of Fernando Mariano
Productions Ltd and is valid at all times whilst the Student
is enrolled on any Upstage Lab activity and until such time as written notice is given in accordance with these Terms & Conditions.

InTRO

1.1     These Terms & Conditions apply to all our Upstage Lab schools, Courses, Holiday Workshops/Camps, Workshops and any additional products and/or services offered by
Upstage Lab and/or its group of companies in the future for any Student (collectively Upstage Lab Activities)
1.2     For participation of a Student in a Upstage Lab Activity all parents or carers are required to consent to these Terms and Conditions by submitting an electronic application form online.  We may update these Terms and Conditions from time to time.
1.3     If you are an existing Parent or Carer of Upstage Lab please read these amended Terms and Conditions carefully.  Unless you contact us within fourteen (14) calendar days of receipt of these new Terms and Conditions, they shall supersede and extinguish all previous agreements between us and shall govern the contractual relationship between us going forwards.  Your continued enrolment of a Student in Upstage Lab Activities shall be deemed as acceptance of these Terms and Conditions and willingness to be bound by the same.  
1.4     Any changes to these Terms and Conditions requires the written consent or approval of Upstage Lab.
1.5     A Course refers to a course of classes offering tuition in dance, drama, and singing which will be delivered during the month of your automatically renewed contract. Course classes will take place for a certain number of hours, as detailed at the time of booking.
1.6     Holiday/Workshop refers to Workshops run by some Upstage Lab schools during the breaks between Terms.
1.7     Principal refers to the director of a local branch of Upstage Lab.
1.8    Workshop refers to a one-off course offering tuition in dance, drama, singing and/or
other performing arts related activities which will be delivered for a certain number of hours per day for a period of between one (1) and five (5) consecutive days and can run at any time throughout the year, availability permitting.
1.9 Client refers to the person paying for tuitions and fees for a certain student or clinical client.
1.10 Clinical client refers to the person under therapy practice.

ENROLLING A NEW STUDENT IN AN Upstage Lab ACTIVITY

2.1     To apply for a place for a new Student on an Upstage Lab Activity, the Parent must purchase a ticket for the determined activity
2.2    Cancellations can be made until 14 days after purchase of a ticket. 
2.3 After this period of 14 days the activity shall be considered non-refundable. 
2.4.2 When buying classes in bulk, can use the classes as they wish, however all packs expire after a period of 6 months. 
 

COURSES

6.1 All individual courses must be held in the individuals home. A parent or carer of the child must be present at all times. If unavailable, an appointed guardian (over 18 years of age) may be present in replacement of the Parent or carer, however this must be pre-arranged and agreed
between the Parent or carer and Upstage Lab.
6.2 A Upstage Lab school may, at its discretion, offer the second child of the same family
attending an Upstage Lab course at the same time, a sibling discount of up to thirty percent (30%) on Course fees. This discretionary sibling discount will only apply if Upstage Lab is
notified of the sibling relationship at the time the Deposit is paid. Only one discount may apply against the Course fee for an individual child at any one time.
6.2  If a Course session falls on a bank holiday then a replacement class will also be added onto the end of the current Term timetable or the subsequent Term.
6.3   Times of classes will be agreed in writing at the start of the first month of enrollment. As enrollment with Upstage Lab will be continual, unless otherwise stated as specified in 6.6, the times of each class will also remain unchanged, unless otherwise agreed between
Upstage Lab and the Parent.
6.4   If there is a wish for classes to be held more regularly than once a week, where possible, this can be facilitated, accounting for the abilities of the child, and the availability of
each party.

WORKSHOPS and HOLIDAY WORKSHOPS/CAMPS

7.1     Parents should contact their local Upstage Lab school to confirm if it is organizing Workshops and/or Holiday Workshops/Camps.
7.2     Dates and times of Workshops and Holiday Workshops/Camps are released in advance on your local Upstage Lab website.  
7.3     For the avoidance of doubt, the Trial Period and sibling discounts detailed in sections 5 and 6 above do not apply to Workshops or Holiday Workshops/Camps.
7.4     If you cancel a student's place on a Holiday Workshop/Camp or Course outside of the
Cancellation Period and within ten (10) calendar days of the commencement of the Holiday Workshop/Camp or Course, the Deposit will be retained by Upstage Lab.
7.5     If you cancel a Student's place on a Holiday Workshop/Camp or Course outside of the Cancellation Period and within seven (7) calendar days before the commencement of the Holiday Workshop/Camp or Course, the Deposit will be retained by Upstage Lab and you will be required to pay the full balance of the fee.

PERSONAL PROPERTY

8.1     Students are obliged to take care of their own belongings. Upstage Lab can accept no liability for lost or damaged belongings.
8.2     You acknowledge that the maximum aggregate liability of Upstage Lab to a Student or Parent under these Terms and Conditions shall not exceed the Upstage Lab Activity fee to which a claim relates.
8.3      The liability of Upstage Lab and that of its staff is restricted to class time only and then only to gross negligence.
8.4 In case a teacher's/therapist's belongings is damaged by gross negligence of a parent or a student the parent will be required to cover for the damage caused within a period of 15 days after the incident. In case this is not done, and there is proof this was the parent or student's negligence the payment for the object will be added to a bill and sent to a debit collect agency.

9.1     Upstage Lab may, at its own discretion, refuse a Student entry to a Upstage Lab Activity or session of a Upstage Lab Activity if it is felt that the Student's behaviour is unacceptable.
10.2     Upstage Lab reserves the right to make changes to the timetable and to the
teaching staff from the advertised programme in the event of illness or other circumstances beyond our control.
10.3     Where a session of a Upstage Lab Activity has to be cancelled by Upstage Lab , Principals will give as much notice as possible. In the event of a last minute session cancellation, you will be notified by email , text message, a call to your mobile phone, and refunded the amount paid for the session. Parents must ensure that they provide their Principal with up-to- date contact details.
10.4     It is occasionally necessary to change the time and/or venue of a Upstage Lab
Activity session. This will only be done if absolutely necessary and Upstage Lab will do its
best to keep class times and locations as similar as possible but unfortunately this cannot
always be guaranteed.
10.5     In the event that a Student is unable to attend a Upstage Lab Activity session, due to
sickness, holiday or a decision by the Parent or Student not to attend, Upstage Lab regrets
that it is unable to refund any payment.
10.6     Upstage Lab Activity fees are reviewed annually and may be increased in
September of each year.
10.7     These Terms & Conditions, together with any Fee Note, Acceptance Letter and/or
Venue Sheet, constitute the entire agreement between the parties which supersedes and
extinguishes all previous agreements, promises, assurances, warranties, representations
and understandings between them, whether written or oral, relating to its subject matter.
10.8     In the event that one or more of the provisions of the Agreement are found to be
unlawful or otherwise unenforceable, those provisions shall be deemed severed from the
remainder of the Agreement.
10.9    The Agreement shall be governed by, and construed in accordance with, the laws of
England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of
the English courts.

 

USE OF PERSONAL INFORMATION

11.1     The personal data (as it is defined in the Data Protection Act 1998) of a Student and/or Parent submitted using the application form will be processed by Upstage Lab  for the purposes of administration, research, in relation to the provision of teaching services in singing, dance and drama.2     Upstage Lab will share this information with external agencies (for example
organizations with responsibility for children's safeguarding) only when required or permitted to do so by law.
11.3     Upstage Lab will not disclose personal data to third parties for marketing purposes although Upstage Lab and its group companies may use personal data for their own marketing and business development purposes, including for the purposes of advertising and promoting new products and/or services by Upstage Lab and/or its group companies.
11.4     Parents who do not wish to receive marketing communications from Upstage Lab or its group companies should inform the Principal in writing.
11.5     Upstage Lab will from time to time take photographs and film footage of Students during Courses, Workshops, Holiday Workshops/Camps and performances for use in Upstage Lab marketing and publicity material. Upstage Lab will not make such photographs or film footage available of any Student who objects or whose Parent objects.
Objections should be made in writing and sent to the Principal.
11.6     Upstage Lab owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, logos and brand elements. Nothing within these Terms and Conditions affects or licences the ownership of these rights. Any intellectual property created during any Course, Workshop or Holiday Workshop/Camp is owned by Upstage Lab. 

HEALTH AND INJURIES

12.1     Students participate at their own risk and are obliged to inform Upstage Lab and its staff of any existing injuries or medical condition. All application forms must have any known medical conditions stated and any changes to such information must be notified to Upstage Lab immediately in writing.
12.2     If you are unsure whether a Student should participate in any activity please consult the Student's GP before enrolling the Student on a Upstage Lab Activity.
12.3     Students must wear suitable footwear and clothing at all times, for all Courses.
12.4     If a Student is unwell or has an accident requiring emergency treatment, the Parent will be responsible for administering treatment and/ or conveying the child to hospital, where/ if indicated.
12.5 The health and safety of all our teachers must also be given paramount importance. Any injuries sustained in the home of the client for fault of home will be accounted on the responsibility of the house owners or tenants.
12.6 For the purposes of healthy and safety, Upstage Lab would kindly ask that any family pets in the home are locked away or not present throughout the period of the session.
12.7 Verbal or physical agressive behaviour against Upstage Lab's staff will not be tolerated under any circumstances. Students or parents are subject to be banned in cases of verbal or physical abuse.
